Documents for court and expert examination

What to provide to the specialist and how to distinguish an out-of-court examination, a review of an existing report and a court-appointed examination.

If proceedings are already under way

  • The case number, court name and questions relevant to the examination.
  • The order appointing the examination, if one has been issued, and the conditions for handling the objects.
  • Documents on purchase, faults, diagnostics and repair, and relevant correspondence.
  • The previous report with all appendices, for a report review.
  • Information on the appliance's location, access, completeness and any alterations.

Before going to court

For an out-of-court examination, provide the object, a description of the situation and the necessary documents. The specialist opinion or review records the results of the agreed work. How to submit the document in a particular case is agreed with your representative, taking account of the applicable procedural rules.

Documents for an application for court-appointed examination

By agreement, an informational letter on the feasibility of the examination can be prepared, stating the proposed questions, specialist's details, required objects and materials, and indicative time and cost. This letter is not a report on the merits and does not replace the court's order appointing an examination.

What you receive on completion

The out-of-court result is a specialist opinion, a review or another document specified in the Invoice-Order. The delivery format, paper copies and electronic document are agreed in advance. For a court appointment, an expert report is issued under the procedure applicable to the proceedings concerned. The service completion certificate and payment documents are provided in accordance with the order terms.

Procedural rules for civil proceedings

An out-of-court opinion or review does not guarantee its admission to the case, a repeat examination or a particular decision. The court assesses the case materials independently. Other types of proceedings are governed by their respective procedural rules.
